Travis County District Attorney’s Office Announces Indictment Against Austin Police Department Officer Gaitan
Travis County, TX – On Thursday, March 9, 2023, a Grand Jury in the 331st Judicial District Court returned a three-count indictment charging Austin Police Officer Alejandro Gaitan with the felony offenses of Aggravated Assault by Public Servant a 1st -degree felony and two counts of Official Oppression a Class A misdemeanor.
Mr. Gaitan’s case will be prosecuted by the Office’s Civil Rights Unit and is pending in the 331st Judicial District Court for Travis County.
The allegations against Mr. Gaitan were investigated and later referred to our office by the Austin Police Department’s Special Investigations Unit in June 2021.
“We are grateful for the Austin Police Department’s prompt action to ensure this incident would come to light as this case was jointly investigated by APD’s Special Investigations Unit and our Civil Rights Unit,” said Travis County District Attorney José Garza. “Holding law enforcement accountable when they break the law is critical to rebuilding community trust and also to the safety of our community.”
