Travis County District Attorney’s Office Announces Indictments Against the Entity Previously Known as the Texas Lottery Commission and Its Former Executive Director
Travis County, TX — Today, Travis County District Attorney Jose Garza announced that on April 21, 2026, a Travis County grand jury indicted the Texas Lottery Commission and its former Executive Director, Gary Grief, for the offense of Abuse of Official Capacity.
The grand jury’s indictment states that on April 22, 2023, the Texas Lottery Commission, along with high-level management agents, Ed Rogers and Clay Kidd, acting within their official duties, intentionally and knowingly misused government resources, including property, services, personnel, or assets in their custody. This misuse involved the Lotto Texas drawing, which was valued at over $300,000 that day. The Texas Government Code required the Commission and the Executive Director to promote and ensure integrity, security, honesty, and fairness in the operation and administration of the lottery. The Commission’s conduct was authorized by Gary Grief, former Executive Director of the Texas Lottery Commission.
In February 2026, the Public Integrity & Complex Crimes Division of the Travis County District Attorney’s Office received the case from the Texas Department of Public Safety for review.
“Our office will hold accountable powerful actors who violate our state laws,” said Travis County District Attorney José Garza. “We thank the grand jury members who heard the evidence and the law and decided that the defendants’ conduct was unlawful.”
The Travis County District Attorney’s Office’s Public Integrity & Complex Crimes Division is prosecuting the cases against the defendant and the commission in the 167th Judicial District Court.
