Travis County Jury Convicts Man of Murder
Travis County, TX — On Thursday, December 11, 2025, a Travis County jury convicted Elliott García, 43, of Murder.
Jury selection for García’s trial started on Monday, December 8, 2025, and testimony began the following day. On Thursday, December 11, 2025, the jury deliberated and found him guilty of Murder. On Friday, December 12, 2025, the jury sentenced him to serve 30 years in the Texas Department of Criminal Justice.
On September 9, 2023, the Austin Police Department arrested García and charged him with Murder for fatally shooting Philip Patrick Foley, 40. APD detectives learned that prior to the shooting, García assaulted a waitress, which led to a confrontation with staff members and patrons at a South Austin strip club, and the staff asked him to leave. While García waited outside the club for a ride, García drew a handgun and shot Foley. García then fled the scene before being caught by APD.
On December 2, 2023, García was indicted for the offense of Murder.
Assistant District Attorneys Jean Sullivan and Dominic Selvera presented the case against García with the support of Victim Counselor Terrience Greene, Investigators Jesse Hernandez and Mike Henderson, Paralegal Allison Matous, and Legal Secretary Ana-Laura Mujica. Austin Police Department Detective Shane Housmans investigated García’s case.
