Travis County District Attorney’s Office Sends Letter to DHS and ICE to Halt Any Removal Proceedings Against Wilber Rafael Garces Perez

Travis County, TX — This morning, the Travis County District Attorney’s Office sent a letter to U.S. Department of Homeland Security Secretary Markwayne Mullin and U.S. Immigration and Customs Enforcement Director David J. Venturella, requesting that removal proceedings against Wilbur Rafael Garces Perez be halted while the investigation into his shooting during an attempted traffic stop by U.S. Immigration and Customs Enforcement (ICE) on Sunday, September 20, 2026, continues. 

Mr. Garces Perez’s ability to participate as a material witness in the ongoing investigation or any future prosecution of this incident will be severely hindered if he is removed from the United States.

To ensure a complete, impartial inquiry into the shooting of Mr. Garces Perez, the Travis County District Attorney’s Office has formally requested that Mr. Garces Perez be allowed to remain in the United States during the pendency of this criminal investigation.
