Travis County District Attorney’s Office Responds to False Accusations About Discovery Violations in Bretches Case

Travis County, TX — Today, Tuesday, August 18, 2026, the Travis County District Attorney’s Office filed a motion in State v. Bretches responding to false accusations regarding discovery from the August 5, 2026, hearing and confirming that our office produced a one-page email and provided it to Defense Counsel in 2024. The filed State’s Notice of a Prior Disclosure of Exculpatory Information and Submission of Supporting Exhibits to Clarify Record aims to ensure that the Court’s hearing record accurately reflects the facts about the email disclosure and to correct any misstatements about that disclosure.

Following months of allegations that the State withheld evidence, the Defense Counsel for Bretches asserted at the last hearing that the State had concealed the 2022 one-page email within discovery documents produced in June 2026. Contrary to Defense Counsel’s direct and unequivocal representations to this Court at the hearing that the email was not previously provided, discovery receipts reveal the opposite and demonstrate that the main claim made in court is incorrect.

In fact, discovery receipts show that the referenced email was previously disclosed to Defense Counsel and made discoverable more than 2 years ago, on May 3, 2024.  

“Victims of police violence during the 2020 protests have waited more than five years to have their day in court,” said Travis County District Attorney José Garza. “Last week, the Court rejected the defendant’s latest unfounded and frivolous allegations. The State and community remain ready for trial.”
