Travis County District Attorney’s Statement Regarding Governor Abbott’s Call to Pardon Daniel Perry
Travis County, Tx — Today, Travis County Judge Cliff Brown rejected Daniel Perry’s request for a new trial filed by his counsel on April 11, 2023. Judge Brown has set Mr. Perry’s sentencing hearing for Tuesday, May 9, 2023, at 9 am.
On April 7, 2023, a Travis County jury found Daniel Perry guilty of Murder and not guilty of Aggravated Assault with a Deadly Weapon.
On June 24, 2021, Mr. Perry was indicted for the felony offenses of Murder and Aggravated Assault with a Deadly Weapon and the misdemeanor offense of Deadly Conduct. Mr. Perry was charged with the murder of Garrett Foster, 28, and with Aggravated Assault with a Deadly Weapon for intentionally and knowingly threatening Justine Nolt with imminent bodily injury by driving a motor vehicle in her direction, which both took place on July 25, 2020. The Deadly Conduct charge remains pending in the County Attorney’s Office.
“Our office continues to stand by the jury’s unanimous decision to convict Daniel Perry for the murder of Garrett Foster,” said Travis County District Attorney José Garza. “We look forward to Mr. Perry’s sentencing on Tuesday so that the family of Mr. Foster may continue to heal.”
